More discovery, more delays and more prejudice to Cisco Torres
Francisco Torres' defense team in the last remaining San Francisco 8 case revealed today that the prosecution produced "an additional 400 pages of discovery" on New Year's Eve 2009. That discovery includes internal police memoranda that point to the existence of documents that before now have not been produced, identified or noted to be lost or destroyed. "
As a result, today's scheduled hearing was postponed to Thursday, February 18.
This additional delay actually benefits Cisco in that it "gives the defense the opportunity to discover more facts, documents and evidence of the missteps and mishandling of evidence by the SFPD and FBI," according to his attorney, Chuck Bourdon. "Additional evidence will strengthen the defense argument that the case must be dismissed for unjustified prosecutorial delay which has prejudiced Cisco's right to a fair trial."
The Feb 18th appearance will set hearing dates on the motion to dismiss and for preliminary examination.
